Are you targeted for an OSHA inspection?

On March 12, 2021, the U.S. Occupational Safety and Health Administration (OSHA) released a new National Emphasis Program (NEP) designed to “significantly reduce or eliminate worker exposures to [COVID-19]” by targeting specific “high-hazard industries or work tasks” with greater frequency of close contact between workers for on-site inspections, outreach, and compliance assistance related to COVID-19 prevention and response measures. Target or high-hazard industries include healthcare, meat and poultry processing, supermarkets, restaurants, discount department stores, general warehousing and storage facilities and correctional institutions. The NEP also includes an expansive secondary target industry list covering a myriad of manufacturing, construction, general merchandise stores, and transportation companies among others.

What This Means for Employers

Employers in the primary target industries now face a greater likelihood of upcoming inspections. As a result, those employers should carefully review all safety measures they have already taken and compare those to measures recommended by federal, state and local authorities. In addition, all employers should keep an eye out for additional guidance from OSHA.

As of Sept 1, 2020 through Jan 14, 2021, OSHA has issued proposed penalties totaling $2,415,691 for violations relating to coronavirus in NJ, NY and Penn alone!

Implement a Systematic Cleaning Program

Make sure you have a plan. Organizations must have a strong custodial plan that can identify the products to be used and the areas that need to be cleaned regularly. For example, different colored wipes should be used for toilets, sinks and dispensers to avoid cross contamination. The mops must be deep cleaned after every use and designated by locations. Fresh and thoroughly washed micro-fiber cloth should be used each time to safeguard employees’ health.

Be Consistent

Continue or revise your plan based on appropriate disinfectant and PPE availability. Dirty surfaces should be cleaned with soap and water prior to disinfection. Routinely disinfect frequently touched surfaces at least daily.

Communicate, Communicate, Communicate

  • Educate workers performing cleaning, laundry, and trash pick-up to recognize the symptoms of COVID-19.
  • Develop policies for worker protection and provide training to all commercial cleaning staff on site prior to providing cleaning tasks.
    • Training should include when to use PPE, what PPE is necessary, how to properly don (put on), use, and doff (take off) PPE, and how to properly dispose of PPE.
  • Ensure workers are trained on the hazards of the cleaning chemicals used in the workplace in accordance with OSHA’s Hazard Communication standard
